Michigan files advertising under UNETHICAL BUSINESS PRACTICES, in the same list as fee-splitting and kickbacks — which tells you how the Board frames a misleading claim.
FALSE OR MISLEADING ADVERTISING is a ground for disciplinary action, listed as one of the “unethical business practices”. Michigan does not give med spas a bespoke advertising rule; it applies the same ground to every licensee the Public Health Code reaches. (Complete through PA 38 of 2025.)

The company that ground keeps is instructive: the same subdivision covers DIVIDING FEES FOR REFERRAL of patients and ACCEPTING KICKBACKS on medical or surgical services, appliances, or medications. Michigan treats a misleading advertisement as the same species of wrong as a kickback, not as a lesser marketing infraction.

If the attorney general has probable cause to believe that a person has engaged, is engaging, or is about to engage in a method, act, or practice that is unlawful under section 3 of the Consumer Protection Act, and gives the required notice, the attorney general may bring an action in accordance with principles of equity to restrain the defendant by temporary or permanent injunction from engaging in the method, act, or practice.
