Massachusetts scope of practice for med spas

MASSACHUSETTS ALREADY GRANTS NURSE PRACTITIONERS INDEPENDENT PRACTICE AUTHORITY — after not less than 2 years of supervised practice following board-recognized certification, or 2 years of alternative experience the Board accepts. ⚠️ BUT THE GRANT IS OVER PRESCRIBING, NOT PROCEDURES: it runs to issuing prescriptions and medication orders and ordering tests and therapeutics, and § 80E leaves everything else to regulations the Board is directed to promulgate. Before those 2 years, prescribing runs on mutually agreed written guidelines and every prescription names the supervisor. Nursing practice separately includes administering what an authorized prescriber has ordered, and every licensee is DIRECTLY ACCOUNTABLE for the safety of the care they personally deliver.
Advanced practice is authorized by the Board, on evidence, not assumed from a license. A registered nurse applying for initial authorization in advanced nursing practice must furnish documentation of either a graduate degree in advanced nursing practice from a school approved by a national accrediting body acceptable to the Board, or a certificate of completion of an approved advanced-practice educational program — AND documentation of current national certification in advanced nursing practice from a professional or specialty certifying organization acceptable to the Board.

What that authorization permits is set by regulation rather than by the statute: the Board shall promulgate advanced practice nursing regulations governing the provision of advanced practice nursing services and related care, INCLUDING the ordering and interpreting of tests, the ordering and evaluation of treatment, and the use of therapeutics — with an express limit that such care shall not include interpreting tests beyond the scope of the nurse’s licensure and training.

⚠️ AND THE STANDARD OF CARE IS THE PHYSICIAN’S. The standards of care to which nurses in advanced practice shall be held are those which protect consumers and provide them with safe and comprehensive care, and shall be STANDARDS COMPARABLE TO OTHER PROFESSIONALS, INCLUDING PHYSICIANS, PROVIDING THE SAME SERVICES. Massachusetts does not grade the duty down to match the license — an advanced practice nurse performing a service a physician also performs is measured against the physician.

Nursing practice involves clinical decision making leading to a strategy of care, and expressly includes THE ADMINISTRATION OF MEDICATION, THERAPEUTICS AND TREATMENT PRESCRIBED BY duly authorized nurses in advanced roles — certified nurse midwives, nurse practitioners, nurse anesthetists and psychiatric nurse mental health clinical specialists — dentists, physicians, and physician assistants. The order may come from any of those; the administering nurse is acting on it, not on their own authority.

Each individual licensed to practice nursing in the commonwealth shall be DIRECTLY ACCOUNTABLE for the safety of the nursing care he or she delivers. A lawful order from a prescriber does not transfer that accountability away from the nurse who carries it out, and neither does delegating the task onward.

✅ MASSACHUSETTS ALREADY GRANTS NURSE PRACTITIONERS INDEPENDENT PRACTICE AUTHORITY — THIS IS SETTLED LAW, NOT A PENDING CHANGE. “A NURSE PRACTITIONER OR PSYCHIATRIC NURSE MENTAL HEALTH CLINICAL SPECIALIST SHALL HAVE INDEPENDENT PRACTICE AUTHORITY TO ISSUE WRITTEN PRESCRIPTIONS AND MEDICATION ORDERS AND ORDER TESTS AND THERAPEUTICS WITHOUT THE SUPERVISION DESCRIBED IN THIS SUBSECTION IF THE NURSE PRACTITIONER OR PSYCHIATRIC NURSE MENTAL HEALTH CLINICAL SPECIALIST HAS COMPLETED NOT LESS THAN 2 YEARS OF SUPERVISED PRACTICE FOLLOWING CERTIFICATION FROM A BOARD-RECOGNIZED CERTIFYING BODY.”

⚠️ BUT READ WHAT THE AUTHORITY IS OVER — IT IS A PRESCRIBING GRANT, NOT A GENERAL LICENSE TO PRACTICE ANY PROCEDURE. The independent authority § 80E confers is “TO ISSUE WRITTEN PRESCRIPTIONS AND MEDICATION ORDERS AND ORDER TESTS AND THERAPEUTICS”. Nothing in the section speaks to which procedures a nurse practitioner may perform; that question is answered by the advanced-practice regulations the Board is directed to promulgate, and § 80E(b) says only “THE BOARD SHALL PROMULGATE REGULATIONS TO IMPLEMENT THIS SECTION.”

⚠️ BEFORE THE TWO YEARS ARE COMPLETE THE DEFAULT IS SUPERVISION BY WRITTEN GUIDELINES, AND THE SUPERVISOR IS NAMED ON EVERY PRESCRIPTION. A nurse practitioner “MAY ISSUE WRITTEN PRESCRIPTIONS AND MEDICATION ORDERS AND ORDER TESTS AND THERAPEUTICS PURSUANT TO GUIDELINES MUTUALLY DEVELOPED AND AGREED UPON BY THE NURSE AND A SUPERVISING NURSE PRACTITIONER WHO HAS INDEPENDENT PRACTICE AUTHORITY … OR A SUPERVISING PHYSICIAN”, and the prescription “SHALL INCLUDE THE NAME OF” that supervisor. The supervisor must also qualify: “SUPERVISION OF CLINICAL PRACTICE SHALL BE CONDUCTED BY A HEALTH CARE PROFESSIONAL WHO MEETS MINIMUM QUALIFICATION CRITERIA PROMULGATED BY THE BOARD, WHICH SHALL INCLUDE A MINIMUM NUMBER OF YEARS OF INDEPENDENT PRACTICE AUTHORITY.”

There is a second route to the same authority for an experienced hire. The Board “MAY ALLOW A NURSE PRACTITIONER … TO EXERCISE SUCH INDEPENDENT PRACTICE AUTHORITY UPON SATISFACTORY DEMONSTRATION OF NOT LESS THAN 2 YEARS OF ALTERNATIVE PROFESSIONAL EXPERIENCE”, provided the Board finds “A DEMONSTRATED RECORD OF SAFE PRESCRIBING AND GOOD CONDUCT CONSISTENT WITH PROFESSIONAL LICENSURE OBLIGATIONS REQUIRED BY EACH JURISDICTION IN WHICH THE NURSE PRACTITIONER … HAS BEEN LICENSED.” This is discretionary — “may allow”, on the Board’s finding, not on the applicant’s assertion.
