Good-faith examination in Kansas
Kansas permits telemedicine to establish the relationship, and then holds it to the in-person standard. The Act says in one line that telemedicine MAY be used to establish a valid provider-patient relationship, and in the next that the same standards of practice and conduct that apply to healthcare services delivered in person also apply to services delivered by telemedicine — as do the same HIPAA patient privacy and confidentiality requirements. It adds two follow-through duties: the provider must give the patient guidance on appropriate follow-up care, and where the patient consents and has a primary care or other treating physician, must send that physician a report of the treatment and services rendered WITHIN THREE BUSINESS DAYS. Prescribing, dispensing, administering or distributing a prescription drug in an improper or inappropriate manner, or for other than a valid medical purpose, or not in the course of the licensee’s professional practice, is unprofessional conduct.
Telemedicine may be used to establish a valid provider-patient relationship.

A person authorized by law to provide and who provides telemedicine services to a patient shall provide the patient with guidance on appropriate follow-up care. Except when otherwise prohibited by any other provision of law, when the patient consents and the patient has a primary care or other treating physician, the person providing telemedicine services shall send within three business days a report to such primary care or other treating physician of the treatment and services rendered to the patient in the telemedicine encounter.

The same requirements for patient privacy and confidentiality under the health insurance portability and accountability act of 1996 and 42 C.F.R. § 2.13, as applicable, that apply to healthcare services delivered via in-person contact shall also apply to healthcare services delivered via telemedicine.

Unprofessional conduct means prescribing, dispensing, administering or distributing a prescription drug or substance, including a controlled substance, in an improper or inappropriate manner, or for other than a valid medical purpose, or not in the course of the licensee's professional practice.
